Overview

This website and all associated services are operated by Fabius Industries. Throughout these Terms, the terms “Fabius,” “we,” “us,” and “our” refer to Fabius Industries. By accessing our website, purchasing any service, or engaging with us through our ticket system, you agree to be bound by these Terms of Service, including any policies referenced herein. These Terms apply to all users of the service, including visitors, clients, and contributors. If you do not agree to these Terms in full, you may not access or use our services. We reserve the right to update, modify, or replace any part of these Terms at our discretion, and it is your responsibility to review them periodically. Continued use of our services following any updates constitutes acceptance of those changes.

Section 1 — Eligibility & Use of Services

By using our services, you represent that you are of legal age in your jurisdiction or have obtained appropriate parental or guardian consent. You agree not to use our services for any unlawful or unauthorized purpose, and you must not violate any applicable laws, including but not limited to intellectual property laws or platform-specific rules such as Roblox’s Terms of Service. Any misuse of our services, including attempts to exploit or harm the service or its users, may result in immediate termination of access. Fabius reserves the right to refuse service to any individual or entity at any time, without obligation to provide justification.

Section 2 — Commission Scope & Agreement

All commissions require a clear and complete written project brief before any work begins. This brief must outline the nature of the requested service, including but not limited to the type of asset or work, the intended style, theme, or era, the expected scope and level of quality, any applicable deadlines, and the agreed payment method and total cost. A structured template may be provided to assist in this process upon ticket creation. Work will not commence until the project scope is fully agreed upon, payment terms are established, and the required deposit has been received. Fabius is not responsible for issues arising from incomplete, vague, or evolving instructions once a commission has begun.

Section 3 — Payment Policy

All payments must be made in United States Dollars via mutually agreed methods. A minimum deposit of fifty percent is required prior to the commencement of any work, with the remaining balance due before final delivery unless otherwise agreed in writing. Pricing is subject to change based on project scope, complexity, and additional requirements. Payments are non-refundable once significant progress has been made, including but not limited to the creation of concepts, drafts, or partial work. In cases where a commission is canceled at an early stage, partial refunds may be issued at the sole discretion of Fabius. Any attempt to initiate a chargeback, dispute, or fraudulent transaction will result in immediate termination of service, permanent blacklisting from Fabius, and may result in further action if deemed necessary.

Section 4 — Delivery & Turnaround

All delivery timelines provided are estimates and are not guaranteed. Turnaround time depends on factors including project complexity, current workload, and client responsiveness. Fabius shall not be held liable for delays caused by unclear instructions, delayed client communication, revision requests, or circumstances beyond our control. By commissioning our services, you acknowledge that timing may vary and agree to reasonable flexibility in delivery expectations.

Section 5 — Revisions & Modifications

Each commission includes a limited number of revisions, typically up to two minor adjustments per item. Minor revisions are defined as small changes that do not alter the fundamental structure or concept of the work. Requests that involve substantial changes to the design, such as altering the theme, style, or overall structure after work has begun, are considered major revisions and may be subject to additional charges or refusal. All revision requests must be submitted within a reasonable timeframe prior to final delivery. Fabius reserves the right to determine whether a requested change qualifies as minor or major.

Section 6 — Intellectual Property & Ownership

Unless explicitly agreed otherwise in writing, all work produced by Fabius Industries remains the intellectual property of Fabius. Clients are granted a limited license to use the commissioned work for its intended purpose but do not obtain ownership rights. Clients may not resell, redistribute, sublicense, or claim authorship of the work. Additionally, clients may not modify the work in ways that violate platform policies, including Roblox’s Terms of Service, or that promote harmful or prohibited content. Fabius reserves the right to display completed commissions in portfolios, advertisements, and promotional materials. All source files and master project files remain the property of Fabius unless exclusive rights are purchased separately through a formal agreement.

Section 7 — Content & Commission Restrictions

Fabius operates across a wide range of genres, including military, historical, and fictional works; however, we do not accept commissions involving explicit, offensive, or otherwise prohibited content. This includes but is not limited to NSFW material, hate-based content, or any work that violates platform rules or applicable laws. Fabius reserves the absolute right to refuse any commission request at its discretion, regardless of reason.

Section 8 — Client Responsibility

Clients are responsible for providing accurate, complete, and clear instructions at the start of the commission. Clients must also ensure that their intended use of commissioned assets complies with all applicable platform rules, including Roblox’s Terms of Service. Fabius is not responsible for any consequences arising from misuse, redistribution, or improper implementation of delivered assets. Clients are expected to review delivered work promptly and communicate any concerns within a reasonable timeframe.

Section 9 — Service Availability & Modifications

Fabius reserves the right to modify, suspend, or discontinue any aspect of its services at any time without prior notice. Pricing, service offerings, and availability may change at our discretion. We also reserve the right to limit or refuse orders based on factors including but not limited to workload, project scope, or client conduct.

Section 10 — Third-Party Platforms

Our services may rely on third-party platforms such as Discord or PayPal for communication and payment processing. Fabius is not responsible for any issues arising from the use of these platforms, including outages, errors, or policy enforcement. Clients agree to abide by the terms and conditions of any third-party services used in conjunction with Fabius.

Section 11 — Limitation of Liability

All services provided by Fabius are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Fabius shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of revenue, data, or business opportunities arising from the use or inability to use our services. In all cases, our total liability shall not exceed the amount paid by the client for the specific commission in question.

Section 12 — Indemnification

By using our services, you agree to indemnify and hold harmless Fabius Industries, its affiliates, and its representatives from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights or applicable laws.

Section 13 — Termination

Fabius reserves the right to terminate or suspend access to its services at any time if a client is found to be in violation of these Terms. In such cases, the client remains responsible for any outstanding payments owed up to the point of termination. Termination does not affect any rights or obligations accrued prior to termination.

Section 14 — Governing Law

These Terms shall be governed and interpreted in accordance with applicable laws within the jurisdiction in which Fabius operates, unless otherwise required by law. Any disputes arising from these Terms shall be handled in accordance with the governing laws.

Section 15 — Changes to Terms

We reserve the right to update or modify these Terms at any time. It is the user's responsibility to review these Terms periodically. Continued use of the service after any changes constitutes acceptance of the updated Terms.
